Custom Stained Glass Art Commission Contract
Commission Agreement:
This commission agreement ("Agreement") is made between Kenneth Rooks / Glass Rooks, hereinafter referred to as the "Artist," and the purchaser of the commission certificate, hereinafter referred to as the "Client."
Scope of Work:
The Client has purchased a commission certificate for a custom stained glass artwork from the Artist. The scope of the commissioned artwork includes the specifications chosen by the Client at the time of purchase, including size, color palette, and complexity level.
Payment:
The Client agrees to pay the agreed-upon commission price based on the complexity level selected at the time of purchase. Payment will be made in full at the time of purchasing the commission certificate.
Design and Collaboration:
The Artist will work closely with the Client to ensure that the commissioned artwork aligns with the Client's vision. The Client may provide reference images, ideas, and preferences to guide the design process. The Artist will create a preliminary design for the Client's approval before proceeding with the final artwork.
Delivery and Timeline:
The delivery timeline for the commissioned artwork will be communicated to the Client after the design is approved. The timeline is an estimate and may vary based on the complexity and other factors. The Artist will make reasonable efforts to complete the artwork within the agreed-upon timeframe.
Ownership and Usage Rights:
The commissioned artwork is an original creation by the Artist and is protected by copyright. The Artist retains all rights to the artwork, including the right to reproduce, display, and distribute the artwork for promotional purposes. The Client may display the commissioned artwork in their personal space and use images of the artwork for personal non-commercial purposes.
Cancellation and Refunds:
The commission certificate is non-refundable after purchase. In the event that the Artist is unable to complete the commissioned artwork due to unforeseen circumstances, the Client will receive a full refund.
Acceptance:
By completing the payment for the commission certificate, the Client acknowledges that they have read and agreed to the terms and conditions outlined in this contract. The completion of the payment for the commission certificate serves as the acceptance of this Agreement.
